You can be arrested for drug possession even if no substance is found on your person. Police need only find a drug “within your control,” meaning it is stored in a place that you have primary access to, such as a car glove box or a container under your bed.
There are seven categories of controlled substances defined by the federal government and the Virginia Drug Control Act. Schedule 1 and 2 drugs are those considered the most dangerous. Possession of heroin, ecstasy, methamphetamine, or cocaine is a Class 5 felony, with potential consequences including 10 years in prison and steep fines. Unauthorized possession of other drugs, including many prescription drugs, are misdemeanor offenses, which can also carry jail penalties and fines.
Virginia is not a medical marijuana state, so any possession of the drug is illegal, with a very minor exception. (A recent bill signed into law provides limited defense for epilepsy patients using cannabidiol or THC-A oil.) Marijuana is classified as a Schedule 1 drug, but has a separate penalty structure under Virginia law. A possession conviction can come with up to 30 days in jail and a $500 fine for a first offense.
